The ALTA 9 Series

The ALTA 9 family gives back coverage for covenant violations, and in the loan forms, encroachments and minerals too.

The minute version

2021 forms vs. -06 forms

  • 2021 v. 01.00 (08-01-2025), replacing the -06 versions: ALTA 9, 9.7 and 9.10, all loan forms.
  • Still -06, not revised: ALTA 9.1, 9.2, 9.3, 9.6, 9.6.1, 9.8 and 9.9 (ALTA chart and policy-forms index).

Loan forms

  • ALTA 9: covenant violations that divest, subordinate or extinguish the lien or impair it; violations at the Date of Policy; enforced removal for a recorded plat setback; recorded environmental-covenant violation notices; encroachments (Section 4); and damage to improvements from excepted easement maintenance or future mineral surface use. Most of this coverage applies only if Schedule B does not identify the matter.
  • ALTA 9.10: the same as ALTA 9, except that the Section 3.a covenant coverage applies only to violations existing at the Date of Policy.
  • ALTA 9.7: ALTA 9 extended to Future Improvements under identified Plans.
  • ALTA 9.3-06: covenant coverage only. No encroachment or mineral coverage.
  • ALTA 9.6-06 / 9.6.1-06: Private Rights, meaning options, rights of first refusal, prior-approval rights and private charges in an excepted covenant instrument. 9.6.1 limits charge priority to current assessments.

Owner's forms

  • ALTA 9.1-06: unimproved land. Covenant violations and recorded environmental-covenant notices.
  • ALTA 9.2-06: improved land. Adds enforced removal for setback violations.
  • ALTA 9.8-06: land under development.
  • ALTA 9.9-06: Private Rights for owners, with no private-charge or assessment coverage.
  • None of the owner's 9-series forms covers encroachments. Use the ALTA 28 series for that.
